At Serving Immigrants, part of our mission is to keep the immigrant community informed with real and verified updates. That’s why we are thrilled to share that on May 6th, the 11th Circuit Court of Appeals issued a game-changing ruling in favor of the rights of detained immigrants.

The decision rejects the ‘mandatory detention’ policy that sought to keep thousands of people behind bars without bail.

What does this mean for you and your family?

If a loved one is arrested by ICE in Florida, Georgia, or Alabama, they can no longer be detained indefinitely without a judicial review. The court has made it clear that living in this country and having ties here grants the fundamental right to a bond hearing before an immigration judge. This legal victory opens the door for many people to await their cases in freedom, surrounded by their loved ones, and not behind the walls of a detention center.

The Justice Bloc: Other Circuits that support this decision

This victory in Florida doesn’t come alone. It joins a strong legal front that is defending the Constitution: 

2nd Circuit (New York, Connecticut, Vermont): It was the first to speak out, calling the government’s policy an unprecedented mandate for mass detention and reaffirming that due process is for everyone.

7th Circuit (Illinois, Indiana, Wisconsin): These states have also joined the rejection, arguing that the law cannot be reinterpreted at the government’s whim to deprive individuals with decades of deep roots of their liberty.

The other side of the coin: Circuits that still support detention

In Serving Immigrants we believe that complete information is power. Therefore, we must point out that this protection is not yet nationwide. There are circuits that, unfortunately, have decided to support the Trump administration’s mass detention policies.

5th Circuit (Texas, Louisiana, Mississippi): It remains the government’s strongest stronghold, allowing detentions without bail to continue in these states.

8th Circuit (Arkansas, Iowa, Missouri, among others): It recently validated the official position, leaving thousands of immigrants in these areas without the benefit of a bail hearing.

There is always a way out: The Writ of Habeas Corpus

It is important for you to know that, even in the states belonging to these restrictive circuits, not all is lost. Although local courts may support prolonged detention, powerful legal tools still exist.

Habeas Corpus is a fundamental legal recourse that allows a case to be brought before a federal judge to challenge the legality of an arrest. If an immigrant has been detained for months without clear justification or a hearing, habeas corpus is the key to demanding that the government explain why it is keeping that person deprived of their liberty. No one should be detained indefinitely without a judge reviewing his case.
